EU says Elon Musk's X in breach of digital content rules

If breach confirmed, EU could fine X (Il Sole 24 Ore Radiocor) - New York, 12 Jul - The European Commission said it had informed Elon Musk's X of its preliminary view that the social media platform was in breach of the Digital Services Act (DSA) in areas linked to dark patterns, advertising transparency and data access for researchers.

It said X designed and operated its interface for the 'verified accounts' with the 'Blue checkmark' in a way that did not correspond to industry practice and deceived users.

It said X did not comply with the required transparency on advertising and failed to provide access to its public data to researchers in line with the conditions set out in the DSA.

"By sending preliminary findings, the Commission informs X of its preliminary view that it is in breach of the DSA," the commission said.

If the commission's preliminary views are ultimately confirmed, it could fine X up to 6% of the total worldwide annual turnover of the provider, and order it to take measures to address the breach.
